Advice on applying for an order to attend court
If you are unsure what assets your debtor has we can apply for an Order that the debtor attends before a Court Officer to be examined about their financial circumstances and what assets they may have.
We do not often recommend applying for these Orders as the Order has to be personally served on the debtor, incurring further costs that are not recoverable and if the debtor evades service this can quickly become costly.
Also the information provided by the debtor during the examination is often limited, although we can instruct an agent to attend on your behalf to question the debtor more thoroughly than the Court Officer would if this is cost effective taking into account the value of your debt.
