We have recently been approached by a number of patients following receipt of a Duty of Candour letter following an internal review of ENT surgical procedures. The duty of candour is a legal requirement for health and care providers to be open and transparent with patients and families when something goes wrong. It requires organisations to:
- Apologise
- Involve patients and families in a review of what happened
- Take actions to improve the quality of care
- Inform patients and families of the actions that will be taken and when they will happen
The duty of candour applies when care has, or may have, contributed to unexpected or unintended harm or death. It was introduced in 2014 for NHS trusts and foundation trusts in England, and extended to other care providers in 2015.
We understand that the review relates to surgical procedures undertaken by a surgeon employed by a third party ‘Medacs’ to support their ENT waiting list. The review has identified concerns regarding the outcomes of some of the procedures performed. The Trust have noted that a proportion of patients who underwent surgery experienced post-operative complications that may be linked to the care provided by the surgeon. These issues varied in severity, and while some patients did not experience any adverse effects, others may have encountered challenges such as infections, complications with healing, or issues related to the surgical procedure itself. The Trust has taken immediate steps to address these concerns, including ceasing further operation by the surgeon and are engaging with Medacs and exploring the possibility of reporting the matter further to ensure a thorough review of the surgeon’s practice.
