In 2014 Mr X was on his way home from a meeting when he stopped to use a public toilet.
As he was leaving the toilets he was pushed into a cubical and sexually assaulted.
Later Mr X found out that he had contracted a sexual transmitted disease as a result of the assault.
Mr X suffered from a breakdown due to effects the assault had on him but found the courage to report what had happened to the Police.
Ison Harrison assisted Mr X with an application to the Criminal Injuries Compensation Authority (CICA). Usually one has two years from the date of an incident to submit the CICA Application (or if the applicant is a minor, two years from their 18th birthday). However, in some circumstances the CICA can waive this limitation period.
Mr X was unable to submit his application within the two years due to his mental health. This reason was accepted by the CICA ad he was allowed to proceed with his claim.
Under the CICA 2012 scheme where an application relates to more than one criminal injury the applicant will be eligible for the full tariff amount for the criminal injury which gives rise to the highest payment and 30 per cent of the tariff amount for the criminal injury with an equal or second highest payment.
However, when contracting a sexual transmitted disease as a result of a sexual assault this is exempt from any reduction. Mr X Was awarded £19,000.00.
