Mr T was a victim of a seriously life-threatening assault.
His injuries consisted of a brain injury, a skull fracture and disabling mental injury for which the award from the CICA was £17,370.00.
In addition, the application included a claim for loss of earnings after the qualifying 28 weeks resulting in an additional payment of £1,859.80.
However, under Paragraph 25 of the Scheme, an award may be withheld or reduced where the conduct of the applicant before, during or after the incident, giving rise to the criminal injury makes it inappropriate to make an award or a full award. In this case the award was reduced by 15% resulting in a net award of £16,345.33.
