As 2007 drew to a close, Mr and Mrs S were celebrating the birth of their beautiful baby daughter who was perfect in every way. Tragically, this dream was shattered when, having developed mild jaundice which the Doctors failed to treat promptly, the levels of bilirubin in Baby E’s blood stream built up to such grossly excessive levels that she suffered catastrophic and irreversible brain damage.
We became involved in early 2008 and immediately set about obtaining medical evidence to assist in determining the cause of this tragedy. Once satisfied that there was no other explanation for Baby E’s injuries, we issued a Letter of Claim to the relevant Health Authority who finally admitted their negligence 13 months later.
Baby E’s needs were, and remain, extremely complex. She has severe cerebral palsy, is profoundly deaf, has limitations upon her vision together with spasticity in her limbs and is unable speak, eat or play like an able-bodied child. It was therefore imperative to ensure we obtained the maximum amount of compensation possible to secure the very best care for Baby E.

8 years on, our legal team of Iain Oliver and Geraldine Kane secured a settlement for Miss E that provided a Lump Sum of £2.7m, plus annual payments of £211,000 until she is 19 years old, rising to £264,000 up to age 21 and £281,000 thereafter for the rest of her life. The settlement was approved by a Judge of the High Court in February 2016,
With the benefit of this settlement Miss E’s strong and determined parents have been able to purchase a substantial property which will now be specially adapted to E’s needs. They can now afford to increase her care team to allow them a little time off, whilst also purchasing specialist 1:1 private therapy plus all the aids, equipment and technology that will help to improve the quality of Miss E’s life enormously.
